Terms of service
Last updated October 19, 2026
These terms are an agreement between SUPERUS Inc., an Alberta corporation (we, us), and the business that signs up for CleanComply (you, the customer). They apply to the CleanComply app at app.cleancomply.ca, the training, templates and other content in it, and the website at cleancomply.ca. By creating an account, signing an order or using CleanComply you agree to these terms on behalf of your business, and you confirm you have the authority to do so. If you have a signed agreement with us, it takes priority where it differs from these terms.
1. A tool to help you manage safety, not a guarantee
CleanComply helps you organize, track and document your health and safety work. It does not make your business compliant with any law, and it is not legal, occupational health and safety or professional advice.
- You remain the employer and remain fully responsible for meeting your obligations under occupational health and safety, workers’ compensation, employment, privacy and other laws in every province and territory where you work.
- Training, checklists, templates, reminders, requirement lists and province guidance in CleanComply are general information. They may not cover every hazard, workplace, task or legal requirement that applies to you, and laws change. You are responsible for deciding what applies to your business and for adding site-specific instruction, policies and training where needed.
- Dashboards, scores and reports show what has been recorded in CleanComply. They are not a certification that you are compliant, and an inspector, auditor, client or court may reach a different view.
- Where CleanComply helps you decide whether an incident may need to be reported to a regulator, it is a guide only. Deciding whether and when to report, and doing so, is your responsibility. CleanComply does not file reports with any government on your behalf.
- CleanComply is not an emergency system. In an emergency, call 911 and follow your emergency procedures. Do not rely on the app to raise an alarm or summon help.
You should get advice from a qualified occupational health and safety professional or lawyer about your specific obligations.
2. Your account and your users
- CleanComply is for businesses. You must give us accurate account and billing details and keep them current.
- You decide who can use your account and which role each person has. You are responsible for everything done through your account, for your users following these terms, and for removing access when someone leaves.
- Sign-in codes are sent to each person’s email or mobile number. Keep those secure and tell us right away if you believe your account has been used without permission.
- When you ask us to set up or support your account, you authorize us to access and work with your records for that purpose. These actions are recorded in your account history.
3. Your data
- You own the records you put in CleanComply, including information about your employees, buildings, training, inspections and incidents. You give us permission to host, copy, process and display them only as needed to provide, secure and support the service and as our privacy policy describes.
- You are responsible for your records: that they are accurate, that you collected them lawfully and that you have given your employees any notice and obtained any consent the law requires. This includes sensitive information such as health details in incident reports, criminal record check information and reports involving workers under 18.
- You decide who in your business can see confidential reports and you are responsible for those choices.
- We may use information that has been combined and stripped of anything identifying you or any person to operate and improve CleanComply. We do not sell your records and we do not use them to train artificial intelligence models.
- Keep your own copies of records you are legally required to keep. You can export your records at any time while your account is active.
How we handle personal information is described in our privacy policy.
4. Acceptable use
You and your users must not:
- use CleanComply for anything unlawful, or to store information you have no right to hold;
- upload harmful code, try to get into accounts or data that are not yours or test, scan or overload our systems;
- copy, resell, rent, reverse engineer or build a competing product from CleanComply or its content;
- share CleanComply training, videos or templates outside your business, except as part of your own safety program;
- harass people through the app, or knowingly submit false reports.
We may remove content or suspend access that breaks these rules or puts other customers or the service at risk.
5. Plans, fees and payment
- Fees are set by your plan and are in Canadian dollars, plus applicable taxes.
- Each plan includes a number of workers. Everyone who can sign in counts as a worker: admins, managers and staff. Archived former staff do not count. You may go up to 10% over your plan’s worker number. Beyond that, new invitations pause until you move up a plan. You can move up at any time and pay only the difference for the rest of your term.
- Annual plans are paid in advance for the year, include one month free and have no setup fee. Monthly plans are billed monthly and have a one-time setup fee. Setup fees are not refundable once setup has started.
- Custom modules included with Scale are scoped and agreed with you during onboarding. Development beyond that scope is quoted separately.
- Invoices are due within 30 days. If an invoice is more than 30 days overdue, we may suspend access after giving you at least 10 days’ notice, and restore it once paid. Your records are not deleted while an account is suspended for late payment.
- Fees paid are not refundable, except where these terms say otherwise or the law requires. We may change prices for a new term by telling you at least 30 days before it starts. Prices do not change during a term you have already paid for.
6. Term, cancellation and your records after you leave
- Your subscription runs for the monthly or annual term you choose and renews for the same length unless either of us cancels before it ends.
- You can cancel by contacting us. Cancellation takes effect at the end of the term you have paid for, and access continues until then.
- We may end your subscription if you seriously break these terms and do not fix it within 30 days of our notice, or right away where the law requires or the breach puts people, other customers or the service at risk.
- Access ends when your account ends. For 60 days after that you can ask us for a complete export of your records, which we send as spreadsheet files together with your certificates, photos and other attached files. After 60 days we delete them, and copies in backups are overwritten within a further 30 days. We are not responsible for keeping records after that time, so export anything you need to keep before you leave.
7. Our service
- We work to keep CleanComply available, secure and backed up, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and we will try to do so at quiet times.
- We improve CleanComply over time. We may add, change or retire features, and we will not remove a core feature of your plan during a term you have paid for without giving you a fair alternative or a pro-rated refund.
- Features marked as early access or beta are offered as they are, may change and may be withdrawn.
- CleanComply relies on service providers such as hosting, email and text message providers. Their availability is outside our full control.
8. Our content and your branding
- CleanComply, its software, design, training, videos, checklists and templates belong to us or our licensors. While your subscription is active you may use them inside your business as part of your safety program. You may not sell or publish them.
- Training and templates you create in CleanComply belong to you, apart from any of our content they include.
- If you give us your logo or brand colours, you allow us to use them to brand your account, reports and videos. You confirm you have the right to give us them.
- Suggestions and feedback you send us can be used to improve CleanComply without any obligation to you.
9. Confidentiality
Each of us will keep the other’s non-public business information confidential and use it only for this agreement, except where it is already public, was received lawfully from someone else or must be disclosed by law.
10. No other promises
Apart from what these terms say, CleanComply and its content are provided as they are and as available. To the extent the law allows, we make no other promises or warranties, including that CleanComply will meet your requirements, that it is fit for a particular purpose or that its content is complete, current or error-free.
11. Limits on our liability
To the extent the law allows:
- We are not liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue, contracts, goodwill or data, even if we were told they were possible.
- We are not liable for workplace injuries, illness, incidents, orders, fines, administrative penalties, prosecutions or claims against you, or for any decision you make or fail to make using CleanComply, because workplace safety and compliance remain your responsibility.
- Our total liability for all claims related to CleanComply is limited to the fees you paid us for CleanComply in the 12 months before the event that gave rise to the claim.
These limits do not apply where the law does not allow them to, such as liability for fraud.
12. Your responsibility to us
You will cover our reasonable losses and legal costs from claims by third parties, including your employees, clients and regulators, that arise from your records, your use of CleanComply in breach of these terms or the law or your workplace health and safety practices.
13. Using cleancomply.ca
The information on cleancomply.ca, including articles, answers and examples, is general information about workplace health and safety and is not legal advice. Examples and sample figures are illustrations. Requesting a tour does not create an obligation for either of us.
14. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change significantly affects your rights, we will tell you by email or in the app at least 30 days before it takes effect. You may cancel before then, and if you do, we refund the unused part of any fees you paid in advance. Continuing to use CleanComply after a change takes effect means you accept it.
15. General
- These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. The courts of Alberta, sitting in Calgary, have exclusive jurisdiction over any dispute.
- Neither of us is responsible for delays caused by events outside our reasonable control, such as outages of the internet or of a service provider, natural disasters or government action.
- You may not transfer this agreement without our written consent. We may transfer it to a business that takes over CleanComply, which must honour these terms.
- If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. Sections that by their nature should continue after the agreement ends, including fees owed, your data, confidentiality, liability limits and governing law, continue.
- These terms, your plan and any signed agreement with us are the whole agreement between us about CleanComply.
